Dear Sir / Madam,
We would like to inform you, that the employees of Poti Sea Port Corporation are still on strike, without notification according to Georgian Legislation as advised by the Corporation. The Corporation has not been providing services in connection with the movement of the vessels (in and out of the harbor) as well as cargo operations up to now. The Corporation confirmed with their circular on 9th of May, 2015 that they will not be able to provide services at all. The Corporation and its administration are negotiating with the Labor Union to reach an agreement as soon as possible. But the Corporation cannot advise the exact date on which the strike will end. The corporation has been announcing that this stoppage constitutes an event of Force-Majeure since the first announcement made on 5th of May, 2015.
In reference to this information received from Poti Sea Port Corporation, we would like to announce the following:
1. Complying with the terms and conditions of MSC Bill of Lading, the port of discharge for all cargo on board of GOZDE BAYRAKTAR 519A has been changed from POTI to BATUMI, as we hereby announce “the end of voyage” for GOZDE BAYRAKTAR 519A for all its cargo discharged in Batumi Sea Port – BICT (Batumi International Container Terminal).
2. The Manifested Consignees and/or their legal representatives are kindly invited to collect their cargoes arrived with GOZDE BAYRAKTAR 519A in Batumi Sea Port – BICT (Batumi International Container Terminal).
3. All additional charges/costs born to the merchants due to this Force-Majeure, that could be raised by 3rd parties, Mediterranean Shipping Company S.A. and its agents as well its servants, are to be covered by merchants.
The present letter is written strictly without prejudice and admission of any liability due to the contents.
